Am I entitled to see a doctor of my choice?
If, following your injury or illness, you were seen by the doctor you were referred to by your employer or the Insurance Company, then you only have 10 days to select a different doctor otherwise the company doctor automatically becomes your treating doctor.
If you are unhappy with your initial choice of treating doctor, in Network cases you need to get the adjuster’s approval after the alternate doctor agrees to accept you as a patient. In Non-Network cases the alternate doctor must agree to accept you as a patient and the alternate doctor normally sends in a DWC 53 to the Division of Workers’ Compensation (DWC). The alternate doctor will request your medical records before accepting you as a patient.
