If you are overpaid on your income benefits, the insurance company may recoup the overpayment upon giving you notice in an amount not to exceed 25% of the income benefit payment. If the insurance company sends you a letter asking for you to pay all of the overpayment back in a lump sum, inform them that is not the law and contact the Division of Workers’ Compensation.
